The court case of Fitzgerald v Barnstable School District. In this case, kindergarten student Jacqueline Fitzgerald complained to her parents that an older student bullied her into lifting up her skirt on several occasions. There were several investigations with both the local police department and the school district, but they all proved not to have enough sufficient evidence to bring criminal proceedings against her harasser. They brought this case to court with the violation of Title IX and 42 U.S.C. 1983(Section 1983). By unanimous decision by Samuel A. Alito, the Supreme Court reversed the U.S. Court of Appeals for the First Circuit, reasoning that Title IX was not meant or substitute for actions filed under section 1983.
